Student Discipline Issues and Considerations for Students with Disabilities
When disciplining a child with an IEP or 504 plan it is always important to consider the information written in the IEP or 504 plan. Any behavioral goals or plans must be reviewed before punishing the student, especially in regards to suspension. If the student’s misbehavior is related directly to their disability, special considerations are required. A student may not be suspended if the misbehavior directly relates to their disability. When the misbehavior is not related to their disability then punishment may be applied as would be appropriate to any other student.
A student with an IEP or 504 plan may be suspended for up to 10 days before any other action is needed. Anything longer than 10 days of suspension is considered a “change of placement” to the student’s academic setting. After the 10 day period has been reached it will be necessary to conduct a Manifestation Determination to determine the causes and any other relating factors to the student’s misbehavior. The school IEP team will conduct a Functional Behavior Assessment (FBA) and create a Behavior Intervention Plan (BIA). Depending on the outcome of the FBA and BIA it may be necessary to add additional behavior goals and supports to the student’s IEP or 504 plan.
